{"id":2212,"date":"2022-02-15T15:56:00","date_gmt":"2022-02-15T18:56:00","guid":{"rendered":"https:\/\/araujopolicastro.com.br\/?p=2212"},"modified":"2024-08-27T15:59:23","modified_gmt":"2024-08-27T18:59:23","slug":"start-of-the-term-of-the-declaration-of-brazilian-capital-abroad","status":"publish","type":"post","link":"https:\/\/araujopolicastro.com.br\/en\/start-of-the-term-of-the-declaration-of-brazilian-capital-abroad\/","title":{"rendered":"Start of the Term of the Declaration of Brazilian Capital Abroad"},"content":{"rendered":"\n<p>Starts today, February 15, 2022, the term for individuals or legal entities residing, domiciled, or that are headquartered in Brazil (including foreigners, according to the applicable criteria of the tax legislation) to present to the Brazilian Central Bank the declaration of assets and funds held overseas (\u201c<strong><u>Declaration of Brazilian Capital Abroad<\/u><\/strong>\u201d), referring to the base date of December 31, 2021, according to Resolution 3854 of May 27, 2010, and Circular 3624 of February 6, 2013.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Form of provision of information.<\/strong>\u00a0The periodicity of provision of information varies depending on the amount of assets and funds held overseas:The declaration is mandatory to all individuals and legal entities that held assets and funds abroad in an amount\u00a0<strong>equal to or higher than USD 1 million, or the equivalent amount in another currency<\/strong>\u00a0on the base date of December 31, 2021, and the declaration must be presented up to\u00a0April 5, 2022 (until 6:00 PM)\u00a0(\u201cAnnual Declaration of Brazilian Capital Abroad\u201d). In addition to the Annual Declaration of Brazilian Capital Abroad, the individuals and legal entities holding assets and funds abroad in an amount\u00a0<strong>equal to or higher than USD 100 million or the equivalent amount in another currency<\/strong>\u00a0must also present the Quarterly Declaration of Brazilian Capital Abroad, as per the schedule below: <strong>(i)<\/strong>\u00a0with respect to the amounts of funds at March 31, 2022, the declaration must be presented in the period from\u00a0April 30, 2022\u00a0to June 5, 2022 (until 6:00 PM); <strong>(ii)<\/strong>\u00a0with respect to the amounts of funds at June 30, 2022, the declaration must be presented in the period from\u00a0July 31, 2022 to September 5, 2022 (until 6:00 PM); and <strong>(iii)<\/strong>\u00a0with respect to the amounts of funds at September 30, 2022, the declaration must be presented in the period from\u00a0October 31, 2022 to December 5, 2022 (until 6:00 PM). * To perform currency conversion, click\u00a0<a href=\"https:\/\/www.bcb.gov.br\/conversao?utm_campaign=informe_empresarial_-_1502_-_start_of_the_term_for_the_declaration_of_brazilian_capital_abroad&amp;utm_medium=email&amp;utm_source=RD+Station\">here<\/a>.<\/li>\n\n\n\n<li><strong>Information to be provided.<\/strong>\u00a0The information to be provided includes data about assets of different natures, such as trade credits (goods and services), financial deposits abroad, investments in derivatives, loans and financial leasing, equity investments, Brazilian Depositary Receipts and\u00a0 bonds, as well as other investments, including real estate and other assets. The detailed description of the assets to be declared is available only in Portuguese on the Declaration Manual (to access such document click\u00a0<a href=\"https:\/\/www.bcb.gov.br\/content\/estabilidadefinanceira\/cambiocapitais\/Manuais_CBE\/Manual%20CBE%20(a%20partir%20de%202017).pdf?utm_campaign=informe_empresarial_-_1502_-_start_of_the_term_for_the_declaration_of_brazilian_capital_abroad&amp;utm_medium=email&amp;utm_source=RD+Station\">here<\/a>).<\/li>\n\n\n\n<li><strong>Effects.<\/strong>\u00a0The failure to provide information (or the failure to provide it within the deadline established) as well as the provision of false, incomplete or incorrect information may subject the violator to the
