LGPD will come into force: Is your company prepared?"},"content":{"rendered":"\n<p>After many comings and goings, as well as several discussions on the topic, the&nbsp;<em>LGPD<\/em>&nbsp;is expected to come into force in a near future.<\/p>\n\n\n\n<p>Thus, from that date, companies need to be in compliance with the rules and duties brought by the&nbsp;<em>LGPD<\/em>.<\/p>\n\n\n\n<p>In summary, the&nbsp;<em>LGPD<\/em>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Regulates the processing of data related to\u00a0<strong>individuals<\/strong>\u00a0only (whether they are employees, candidates to a position, customers, partners, service providers, suppliers, etc.);<\/li>\n\n\n\n<li>It applies regardless of the means and\/or form of data processing, that is, it imposes rules on data processing carried out inside or outside the internet, using or not digital means;<\/li>\n\n\n\n<li>It applies to treatment operations that occur in the Brazilian territory, but also to treatment operations that occur outside the country, when:<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Personal data is collected in Brazil;<\/li>\n\n\n\n<li>The data are related to individuals located in the Brazilian territory;<\/li>\n\n\n\n<li>Its purpose is to offer products and\/or services to the Brazilian public.<\/li>\n<\/ol>\n\n\n\n<p>Basically, the processing of personal data can occur:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Upon consent;<\/li>\n\n\n\n<li>To comply with legal or regulatory obligations;<\/li>\n\n\n\n<li>By the public administration;<\/li>\n\n\n\n<li>For carrying out studies by research bodies;<\/li>\n\n\n\n<li>When necessary for the execution of the contract;<\/li>\n\n\n\n<li>For the regular exercise of rights in judicial, administrative or arbitral proceedings;<\/li>\n\n\n\n<li>For the protection of life or physical safety of the holder or third party;<\/li>\n\n\n\n<li>For the protection of health;<\/li>\n\n\n\n<li>When necessary to serve the legitimate interests of the controller or third party;<\/li>\n\n\n\n<li>For credit protection.<\/li>\n<\/ul>\n\n\n\n<p>Thus, the company must implement practices and routines to be in compliance with the&nbsp;<em>LGPD<\/em>, in order to avoid data leakage and the application of sanctions\/penalties for non-compliance with the law.<\/p>\n\n\n\n<p>It is a very complex and delicate topic, but it
