Anticipation of municipal and state holidays in São Paulo from a labor perspective
On Tuesday (19/5) a Decree was published that determines the anticipation of municipal holidays. The goal is to increase social isolation through an extended holiday later this week.
According to the text approved by the City Council of the city of São Paulo, the holidays of Corpus Christi (June 11) and Consciência Negra (November 20) will be brought forward to this Wednesday (May 20) and Thursday (May 21), respectively. In addition, Friday (May 22) was declared an optional point in the city of São Paulo.
In view of this scenario, employees who provide services in the city of São Paulo must take advantage of Corpus Christi and Consciência Negra holidays in advance, on the days indicated above.
Thus, analyzing the issue from a labor perspective, employees who provide services on those days, without compensatory time off in the same week, should receive the hours worked with the additional provided for in the applicable collective rule.
The anticipation of holidays provided for in the Decree does not apply to health, urban security, social assistance and funeral services units, in addition to other units whose activities cannot be resolved.
Finally, it is important to note that, in the same way, the Governor of the State of São Paulo also forwarded a bill to the Legislative Assembly to anticipate the state holiday of July 9 (day of the Constitutionalist Revolution) to next Monday, may 25th. Approval must be released no later than Thursday (5/21), applying the same rules for municipal holidays.
